These Terms and Conditions ("Terms") govern your use of the website www.maiva.co (the "Site") operated by Armaara Innoventures Pvt. Ltd. ("Company", "we", "us", or "our"), a company incorporated under the laws of India, with its registered office at 405/6-B, Kotia Nirman, Oshiwara Link Rd, Andheri (W), Mumbai 400053.

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years of age to use this Site and place orders. By using the Site, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding agreement.

2. Products and Availability

All products listed on the Site are subject to availability. We reserve the right to discontinue, modify, or limit the availability of any product at any time without prior notice. Product images on the Site are for illustrative purposes only; actual products may vary slightly in appearance due to packaging updates or display settings.

Maiva Fresh products are available exclusively for delivery within Mumbai. Orders placed from other locations for these products will not be fulfilled.

3. Pricing

All prices listed on the Site are in Indian Rupees (₹) and are inclusive of applicable taxes unless stated otherwise. We make every effort to ensure pricing accuracy; however, in the event of a pricing error, we reserve the right to cancel the order and issue a full refund. Prices are subject to change without prior notice.

4. Orders and Payment

Placing an order on the Site constitutes an offer to purchase. We reserve the right to accept or reject any order at our discretion, including due to product unavailability, pricing errors, suspected fraud, or issues with payment verification.

Payment can be made via credit/debit cards, UPI, net banking, wallets, or Cash on Delivery (COD) as available at checkout. Orders will be processed upon successful payment confirmation (or upon delivery for COD orders).

5. Shipping and Delivery

Shipping and delivery of orders are governed by our Shipping Policy, which is available on the Site and forms part of these Terms. We are not liable for delays caused by courier partners, natural calamities, or other circumstances beyond our reasonable control.

6. Replacements and Refunds

Our Refund & Replacement Policy, available on the Site, governs all matters related to product replacements and refunds. Due to the consumable nature of our products, we do not accept returns. Replacements are offered only for damaged, defective, incorrect, or expired products, subject to the conditions outlined in the policy.

7. Intellectual Property

All content on the Site — including but not limited to text, graphics, logos, images, product descriptions, brand names (Maiva, Maiva Pro, Maiva Life, Maiva Fresh, Maiva Frappé), trademarks, packaging designs, and software — is the property of Armaara Innoventures Pvt. Ltd. or its licensors, and is protected under applicable intellectual property laws.

You may not reproduce, distribute, modify, display, or create derivative works from any content on the Site without our prior written consent.

8. User Accounts

If you create an account on the Site, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account. We reserve the right to suspend or terminate accounts at our discretion.

9. Prohibited Conduct

You agree not to:

(a) Use the Site for any unlawful or fraudulent purpose.

(b) Interfere with or disrupt the Site’s functionality, servers, or networks.

(c) Attempt to gain unauthorised access to any part of the Site or its systems.

10. Limitation of Liability

To the fullest extent permitted by law, Armaara Innoventures Pvt. Ltd. shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to your use of the Site, purchase of products, or reliance on any information provided on the Site. Our total liability for any claim shall not exceed the amount paid by you for the product giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless Armaara Innoventures Pvt. Ltd., its directors, officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising out of your breach of these Terms, misuse of the Site, or violation of any applicable law or third-party rights.

12. Force Majeure

We shall not be liable for any failure or delay in performing our obligations due to causes beyond our reasonable control, including but not limited to natural disasters, pandemics, strikes, government actions, war, civil unrest, fire, flood, or disruption to utilities or telecommunications.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

15. Amendments

We reserve the right to modify these Terms at any time. Updated Terms will be posted on the Site with a revised effective date. Your continued use of the Site following any changes constitutes acceptance of the revised Terms.
